Research into risk analyses of providers: adjustment of regulations needed

(Netherlands).- The Netherlands Gambling Authority (Ksa) has investigated the risk analyses of the gaming offerings of online gambling licensees. This investigation shows that the risk analysis system included in the regulations is not functioning properly. Furthermore, carrying out these risk analyses requires a great deal of effort and therefore costs for online providers, while it appears to offer little additional protection for players.

Duty of Care for Online Providers
When the online gambling market opened in October 2021, a set of measures was included that online providers must adhere to. These measures are intended to prevent gambling addiction as much as possible and are known as the duty of care. Part of this duty of care is that online gambling providers must conduct (or commission) a risk analysis of their gaming offerings to determine the level of risk. Based on the risk, online providers must take (additional) preventive or protective measures to protect players.

Investigation
The Ksa has investigated how online providers conduct (or commission) this risk analysis. The study examined the methods used for the risk analysis. It also looked at the external organizations that conducted the risk analyses and the departments or officials involved at the online providers. The study revealed that five different research methods were used.

Differences in Results
Furthermore, the study revealed that the risk analyses do not produce consistent results, even when conducted by a single party or when different providers offer the same games. This makes it difficult to compare the results of all the analyses performed. It was also noted that online providers usually conduct the risk analysis per (game) category level, rather than per individual game. This can result in certain games being classified too low within a category. The regulations do not include any rules on this.

The Ksa therefore concludes that the current system is not functioning optimally and is in discussions with the Ministry of Justice and Security about future improvements, so that a more uniform system for determining the risk analysis can be established.
